Recent Events

 Secretary LaHood Announces Recovery Act Funding for Greenhouse Gas and Energy Reduction. On March 24, USDOT Secretary Ray LaHood announced the availability of $100 million in federal funding under the American Recovery and Reinvestment Act, 2009, for the Transit Investments for Greenhouse Gas and Energy Reduction grant program. Projects will compete for a portion of the funds on the basis of how much their proposed capital investment is expected to reduce either energy consumption or greenhouse gases, or both, among other measures. FTA will post application instructions and additional information on its website atwww.fta.dot.gov.CLEAN TEA Bills Introduced to Reduce Greenhouse Gas Emissions. On March 11, US Senators Thomas Carper (D-Del.) and Arlen Specter (R-Penn.) and Representative Earl Blumenauer (D-Ore.) with several co-sponsors, introduced legislation that would establish a low greenhouse gas transportation fund (S. 575 and H.R. 1329). The Clean Low-Emissions Affordable New Transportation Equity Act, or CLEAN TEA, would be funded by 10 percent of the money generated from the auction of greenhouse gas emissions allowances in a climate change bill. EPA Seeks Comment on Annual U.S. Greenhouse Gas Inventory. On March 4, EPA released a draft of their annual inventory of U.S. Greenhouse Gas Emissions and Sinks: 1990-2007. The report indicates that CO2 emissions from transportation sources were 0.34 percent higher in 2007 than in 2006. The draft report will be open for public comment through April 9.

Reps. Waxman and Markey Release Draft of Joint Energy and Climate Legislation. The draft of “American Clean Energy and Security Act of 2009,” released on March 31, includes a proposal for a cap and trade program and several provisions related to the transportation sector. It includes requirements to establish transportation-related greenhouse gas emissions goals and inclusion of a plan to achieve those goals in some metropolitan long-range transportation plans and transportation improvement programs. The legislation also calls for greenhouse gas emission standards on new vehicles including heavy duty on-road and non-road, marine, locomotive, and aircraft engines. Full text of the proposed legislation is available here

State News

CaliforniaReleases Proposed Regulations for Low Carbon Fuel Standard. On March 5, 2009, the California Air Resources Board released proposed regulations for a Low Carbon Fuel Standard (LCFS), which would require transportation fuel providers to lower the life-cycle carbon intensity of their fuels over the next decade. Pew Center for Global Climate Change – State Climate Action Plans. The Pew Center keeps a database of comprehensive Climate Action Plans which have been completed by many states. For more information, see the Pew Center’s State Climate Action Plans Clickable Map.

Announcements

DOE Funding Available for Transportation Projects that Conserve Energy. The America Recovery and Reinvestment Act of 2009 appropriated $3.2 billion for The Energy Efficiency and Conservation Block Grant Program. Transportation strategies are eligible for funding. Eligible transportation projects include, but are not limited to:

  • Employee flex time programs;
  • Promoting use of satellite work centers;
  • Development and promotion of zoning guidelines or requirements that promote energy efficient development;
  • Development of infrastructure such as bike lanes and pathways and pedestrian walkways;
  • Synchronization of traffic signals;
  • State/locals/regional integrated planning activities (i.e. transportation, housing, environmental, energy, land use) with the goal of reducing greenhouse gas emissions and vehicle miles traveled;
  • Incentive programs to reduce commutes by single occupancy vehicles;
  • Improvements in operational and system efficiency of the transportation system such as implementation of intelligent transportation system (ITS) strategies;
  • Idle-reduction technologies and/or facilities to conserve energy, reduce harmful air pollutants, and greenhouse gas emissions from freight movement; and
  • Installation of solar panels on interstate rights-of-way to conserve energy in highway operations and maintenance activities.

2009 Transportation, Planning, Land Use and Air Quality Conference to focus on Climate Change. The conference, sponsored by the Transportation Research Board, FHWA, and others, will explore the latest research in the coordination of transportation, land use and air quality with a specific focus on climate change strategies. Asset Management and Adapting to Climate Change Webinar, April 23. FHWA’s Office of Asset Management in cooperation with AASHTO is conducting a webinar that will provide an overview of climate change and management of highway infrastructure and will focus on the issue of adapting transportation infrastructure to the effects of climate change. This is one in a series of free webinars that FHWA and AASHTO conduct quarterly to provide support to transportation agencies as they develop and implement asset management programs. U.S. DOT Launches Web-Based Clearinghouse of Transportation, Climate Change Resources. The USDOT has launched a new, web-based clearinghouse of information on transportation and climate change. The site provides an introduction to climate change and transportation and related information on greenhouse gas inventories and forecasts, methodologies for analyzing greenhouse gases from transportation, climate change and adaptation, and federal, state and local actions on transportation and climate change. The site also includes a calendar of events and will soon be enhanced to provide an opportunity for users to post and respond to discussions and receive updates by email. Hang Up And Fly – Oregon lawmaker hell bent on losing the little respect he ever earned as politician

Boneheaded politician pushes for legislation aimed at banning in-flight cellular communications.

An increasing number of airlines think the person next to you should be able to chatter away on a cell phone, something some consider the best thing to happen to air travel since in-flight cocktails and others warn will make flying even more hellish.

In-flight cell service has proven quite successful in Europe, where people have chatted the friendly skies on more than 10,000 flights. Although several U.S. carriers offer in-flight Wi-Fi, we’ve yet to see them roll out in-flight phone service, which is still prohibited by the FAA and the Federal Communications Commission.

Some aren’t waiting for the technology to arrive. A group of lawmakers led by Rep. Pete Fazio, D-Ore., have drafted legislation called the Halting Airplane Noise to Give Us Peace (HANG-UP, get it?) Act to ban in-flight cell phone use. Proponents of the bill say the incessant chattering of passengers would make life unbearable for passengers already dealing with delayed flights, crowded planes and the hassle of flying.

But a growing number of passenger rights groups and small business organizations argue the government is grossly overstepping its authority and hasn’t done its homework.

“Given the increased difficulties we face in getting to our destinations these days Americans are spending more and more time at airports and on board commercial aircraft,” says Kate Hanni, executive director of the Coalition for an Airline Passengers’ Bill of Rights. “We believe it is essential that the federal government perform a full inquiry before deciding whether to ban the use of wireless communications on commercial flights and that all the relevant benefits and information be considered before a decision is made before Congress.”

Mary Kirby over at Runway Girl agrees. She’s a vocal opponent of the Hang-Up Act and questions the government’s attempt to outlaw technological advancement. “If in-flight mobile usage hasn’t been a problem in Asia, Europe, and the Middle East, why on earth do you think it would be a problem here,” shewrites in a recent post.

It wouldn’t be, according to Emirates executive Patrick Brannelly, who told Kirby the legislation may mark the first time Congress has tried to legislate good manners.

“At the end of the day, people can be rude and disrespectful on aircraft without a phone,” he said. “And it sometimes happens, but if they are being charged a few dollars a minute to make a phone call, it gives [people] pause.”

But lawmakers pushing for the ban believe they speak for the majority of passengers when they say commercial airlines should be cell-free zones.

“I think many Americans understand the potential for problems on aircraft if 100 or more people start talking on cell phones,” DeFazio said. “People are in very, very close quarters and this is a circumstance where you would have a cacophony of people on cell phones that would amount to a great potential for trouble.”

DeFazio introduced the bill in April, but so far nothing’s happened with it. Let’s hope it stays that way. Although we can think of nothing worse than being stuck next to some pinhead yammering away incessantly during a transcontinental flight, this isn’t an area the government needs to get involved in.

TG Musings # 1: This is very illogical and idiotic – TransportGooru wonders aloud if Rep. DeFazio has ever traveled across the country in GreyHound or Amtrak? If he did, probably he failed to recognize that there are no such rules about attending to a cellphone call while you are cruising on the highway or riding the rails at 60 mph.  What difference does it make if the mode of transportation? A phone call is a phone call and if it can be attended to during a train/bus travel why not it be made during the flight?  Interference with flight to ground communications can be somewhat acceptable (which in itself is a very questionable argument anyway due to the various studies conducted that totally disproved this theory) as a reason for prohibiting these phone calls.  But that’s not even in this picture painted by Rep. DeFazio.  Americans are decent people and they are much more courteous and well-behaved than you can think.If Rep. DeFazio’s logic is squarely based on his experience dealing with the people’s representatives around him in the Congress, no wonder he thinks there is a potential for problems if 100 or more people start talking at the same time – which is what politicans are prone to do, right?   With a country full of smart people,  it makes one wonder how come such people elect illogical politicians to be their intelligent voice on such societal issues? I hate to use the word Bonehead, but I think it is the only suitable word that can be applied to someone with this sorta logic (or lack thereof), Rep. DeFazio. 

TG Musings # 2:  Social Equity – This is a big issue, Rep. Defazio.  A big business owner flying First Class  can afford a $2/min phone call. He would go ahead and do it with the carrier operated, over-priced inflight phone system.  The average Joe Smith/Jane Doe on the street who is flying across the country (often on discounted fares) in the coach class does not have that kind of money.  Especially, in this poor economic climate!!! If anything he or she is already paying through his/her nose for a cellphone (that handles both personal and his small business needs) but still can’t use it, thanks to the existing FAA rule.  He/she would still hold a peice of technology in his pocket that is all well capable of making that phone call from 30K feet, but because of a logically-deficient politican he/she will never be able to make that call.  Let’s say for argument sake, if 10 businessmen in first class decide to make a phonecall at a given moment (hypothetically speaking), doesn’t that account to cacophony? You are not going to convince those business men – “People are in very, very close quarters and this is a circumstance where you would have a cacophony of people on cell phones that would amount to a great potential for trouble.” – Are you Rep. DeFazio?  If you can work  so hard on helping people not just in Oregon but across the country, please refrain from pushing this bill forward. You should spend a couple of minutes to rethin/revise your flawed logic and help all American’s in winning that  the rest of the world rightfully enjoys (i.e.,  in-flight cellular voice calls).  I am sure you want us Americans to be globally competitive in this economy and be ready to serve the needs of our business customers anytime anywhere!

Recent Events

U.S. Senator Barbara Boxer Announces Principles for Global Warming Legislation. On February 3, Sen. Barbara Boxer (D-CA) announced her intent to move quickly on global warming legislation and issued principles that she would like to see included. These include setting short and long term emissions targets that are certain and enforceable, using a carbon market to fund various efforts to reduce GHG emissions, and ensuring a level global playing field so that countries contribute their fair share to GHG emissions reductions. House Subcommittee Receives Testimony on Surface Transportation Energy Reduction.On January 27, the House Transportation and Infrastructure Subcommittee on Highways and Transit heard from nationally recognized transportation experts and a panel of industry representatives about ways to reduce energy consumption and promote sustainability in the surface transportation sector.  Video of the proceedings and written testimonies (scroll down) are available on the Subcommittee website.

United Nations Conference on Trade and Development Holds Meeting on Maritime Transport and the Climate Change Challenge. On February 17, FHWA’s Mike Savonis presented (via videoconference) results from USDOT’s Gulf Coast Study Phase I to an international audience in Geneva.  Additional information and presentations from the three-day event are available on the meeting website.

U.C. Davis Provides Congressional Briefing on Low-Carbon Transportation Policies & Strategies. On January 12, 2009, the University of California at Davis (UC Davis) Institute of Transportation Studies provided a briefing to Congressional staffers on the future of low-carbon transportation.  House Subcommittee Conducts Hearing on Monitoring GHG Emissions.  On February 24, the House Science and Technology Subcommittee on Energy and Environment conducted a hearing on how to monitor, report and verify greenhouse gas emissions.  The purpose of the hearing was to determine the federal role in the funding of research and development of monitoring technologies as well as models to support reliable baseline data for GHG emissions.  The subcommittee heard testimony from businesses, government agencies, and localities on procedures and methods that can be used to monitor, report, and verify greenhouse gas emissions.  More information can be found on the Committee’s website at: http://science.house.gov/publications/hearings_markups_details.aspx?NewsID=2359

State News

Oregon Governor Introduces VMT Fee Legislation. Following a study on charging a Vehicle Miles Traveled (VMT) fee in place of a state gas tax, the Governor of Oregon introduced legislation that could move the state closer to adopting a per mile road user fee in place of the 24-cent per gallon gas tax. Governor Kulongoski’s Jobs and Transportation Act of 2009 requires the Oregon DOT to develop VMT fee collection technology that could be used to replace the gas tax.  The Act also directs Oregon DOT to further study gas tax alternatives.

Regional Greenhouse Gas Initiative Enters First Compliance Period. The ten signatory states to the Regional Greenhouse Gas Initiative (RGGI) began their first compliance period on January 1, 2009 and the period ends in December 2011. At that time the ten Mid-Atlantic and New England states will be required to submit emissions allowances equivalent to their carbon dioxide emissions. New Energy and Climate Change Database for Planners.  The American Planning Association has launched a new database of energy and climate change activities in planning.  You can search the database by a variety of criteria such as state, topic, planning tool, timeframe, or geographic scale.  The database includes many examples relating to transportation.  The database website iswww.planning.org/research/energy/database.

Summit on America’s Climate Choices, March 30-31 in Washington, D.C. Congress has tasked the National Academies with setting the stage for national action on climate change. In response, the Academies have launched America’s Climate Choices, a suite of activities that will provide policy advice, based on science, to guide the nation’s response to climate change. Experts representing various levels of government, the private sector, nongovernmental organizations, and research and academic institutions have been selected to serve on four panels and an overarching committee.    The Summit on America’s Climate Choices provides an opportunity for study participants to interact with major thought leaders and key constituencies to frame the questions and issues that the study will address.  Registration and webcast information are available on the Summit website.  In addition to the summit, NAS is soliciting public input on the questions and content to be considered by the America’s Climate Choices Committee through the America’s Climate Choices website through April 17.

Witnesses testify before the Subcommittee

On Tuesday, March 31, 2009, the Subcommittee on Technology and Innovation convened a hearing to address the research agenda required to mitigate the environmental impact of the transportation infrastructure on the environment, with an emphasis on climate change. Witnesses will address the components of such an agenda and possible implementation strategies.

This was the third in a series of hearings that the Subcommittee has convened on the impact of our transportation system on the environment. The first addressed regulatory barriers to the utilization of green technologies that mitigate surface water runoff from our roadways and parking areas. As a result, the Subcommittee reported H.R. 5161, the Green Transportation Infrastructure Research and Development Act, in the 110th Congress to address this issue.

The second hearing explored the R&D agenda required to improve energy efficiency and lessen the environmental impact of the pavements used in our transportation infrastructure.  The focus of today’s hearing was to examine the R&D that is required to help mitigate the impact of our transportation infrastructure on the climate.

The press release from the event outlines the DOT’s efforts.  The Department of Transportation (DOT) funds research on strategies to reduce the impact of the transportation sector on the environment, but the interest in addressing climate change is relatively new. The following research categories would support the reduction of carbon emissions from transportation:

• Forecasting and analytical tools to support state and local global warming studies;
• Tools to assess system performance;
• Travel behavior;
• Demand management;
• Congestion; and
• Energy use in materials.

“We need to think about improving the energy efficiency of our transportation system, not just the cars and trucks on it,” added  Chariman David Wu. “For example, what are the modeling tools that would help communities develop an effective mixed-use transportation system of cars, buses, light rail, trolleys, and bikes like we have in Portland? If we are serious about congestion mitigation and traffic management, what’s required to realize these goals?”

Throughout the 111th Congress the Technology and Innovation Subcommittee will continue its work to decrease the impact of our transportations systems on the environment. In May 2007, the Subcommittee held a hearing to address the regulatory barriers preventing the utilization of green technologies. This hearing resulted in creation of H.R. 5161, the Green Transportation Infrastructure Research and Technology Transfer Act. In June of 2008, the Subcommittee held a hearing to review sustainable, energy-efficient transportation infrastructure.

Climate bill takes aim at transportation emissions on land and at sea

Roughly one-third of the nation’s total greenhouse gas emissions are from the transportation sector, according to government estimates, and several key lawmakers have said that no climate and energy measure can be complete without addressing transportation.

Sweeping climate and energy legislation that Democratic leaders of the House Energy and Commerce Committee unveiled yesterday takes direct aim at greenhouse gas emissions from vehicles across the transportation spectrum, from passenger cars to oceangoing ships.

 The bill from Reps. Henry Waxman (D-Calif.) and Ed Markey (D-Mass.) would create a suite of federal emissions standards for cars and light trucks, as well as trains, heavy-duty trucks, and ships. It also seeks to curb emissions by pushing the development of plug-in electric vehicles and infrastructure and by setting a “low-carbon fuel standard” for the transportation sector.

Roughly one-third of the nation’s total greenhouse gas emissions are from the transportation sector, according to government estimates, and several key lawmakers have said that no climate and energy measure can be complete without addressing transportation.

One of the bill’s provisions would require the president to “harmonize” federal auto fuel economy standards with any future emissions levels set by U.S. EPA and the strict emissions standards that California is hoping to enforce later this year, if it receives the waiver it needs to do so.

Earlier this year, the White House signaled that it was considering a similar move that would blend new corporate average fuel economy, or CAFE, standards with the auto emissions standards California is fighting to enforce. Under the federal Clean Air Act, California is the only state that can enforce its own standards — but only with an EPA waiver. If California receives the waiver, other states would be permitted to enforce the same tailpipe standard. Thirteen other states and the District of Columbia have already moved to adopt the stricter standards, and a handful of others have indicated they will follow if the waiver is granted.

The Waxman-Markey bill also pushes for greater use of plug-in electric cars and trucks, which are seen as a promising way to curb emissions and displace oil consumption by using electricity in the transportation sector.

The bill calls for states and utilities to develop plans to support the use of plug-in hybrid electric vehicles and all-electric plug-ins and for the Energy Department to launch a large-scale electric demonstration program. The state plans would determine how utilities would accommodate large fleets of plug-ins and would consider a host of charging options — including public charging stations, on-street charging, and battery swapping stations — and establish any necessary standards for integrating plug-ins into an electrical distribution system, including Smart Grid technology.

GAO’s Report on HSR Recommends Significant Federal Role

General Accountability Office sees federal involvement in planning and financing as necessary for high-speed rail construction

The U.S. Government Accountability Office (GAO), Washington’s in-house accounting firm, studied high-speed rail in its most recent report (”High Speed Passenger Rail: Future Development Will Depend on Addressing Financial and Other Challenges and Establishing a Clear Federal Role,” PDF) and came to some significant conclusions about how best to proceed in implementing fast train links in the United States. GAO’s report also indicated strong government support for investment in high-speed rail in corridors of distances between 100 and 500 miles, which the study indicated were best-suited for such connections.

The Transport Politc states that “GAO’s push to incorporate high-speed rail into the broader ground transportation program is elemental for the future of rail in the U.S. That’s because – as GAO’s study indicates – fast trains need to be put into comparison with highways and airports when considering the manner in which Americans will get around in the future. Without such direct, cross-modal comparisons, there is little chance for establishing whether rail, road, or air connections are priorities; without the comparison, we get the status quo, where funding allocations are close to random and where few question which transportation mode fits best where.

The GAO study made the following  Recommendations for Executive Action:
Recommendation #1: To ensure effective implementation of provisions of the PRIIA related to high speed rail and equitable consideration of high speed rail as a potential option to address demands on the nation’s transportation system, the Secretary of Transportation should, in consultation with Congress and other stakeholders, develop a written strategic vision for high speed rail, particularly in relation to the role high speed rail systems can play in the national transportation system, clearly identifying potential objectives and goals for high speed rail systems and the roles federal and other stakeholders should play in achieving each objective and goal.

Recommendation# 2: To ensure effective implementation of provisions of the PRIIA related to high speed rail and equitable consideration of high speed rail as a potential option to address demands on the nation’s transportation system, the Secretary of Transportation should, in consultation with Congress and other stakeholders, develop specific policies and procedures for reviewing and evaluating grant applications under the high speed rail provisions of the PRIIA that clearly identify the outcomes expected to be achieved through the award of grant funds and include performance and accountability measures.

Recommendation# 3: To ensure effective implementation of provisions of the PRIIA related to high speed rail and equitable consideration of high speed rail as a potential option to address demands on the nation’s transportation system, the Secretary of Transportation should, in consultation with Congress and other stakeholders, develop guidance and methods for ensuring reliability of ridership and other forecasts used to determine the viability of high speed rail projects and support the need for federal grant assistance. The methods could include such things as independent, third-party reviews of applicable ridership and other forecasts, identifying and implementing ways to structure incentives to improve the precision of ridership and cost estimates received from grant applicants, or other methods that can ensure a high degree of reliability of such forecasts.

Congress takes a step towards “completing America’s streets”

Did you know that almost half of all the trips we take each day are under three miles? So why aren’t more of us walking or biking for some of these shorter trips each day? Frankly, most of our streets just aren’t designed for safe and comfortable use by everyone — and almost all of us are pedestrians at some point during each day.

Complete streets are safe and accessible for everyone that needs to use them — cars, transit users, bicyclists, pedestrians, young, old, disabled, and everyone else.

Over the last two days, Complete Streets bills have been introduced in both the House and Senate.

Introduced by Sen. Tom Harkin in the Senate, and Rep. Doris Matsui in the House, these bills need our support — and more congressional sponsors. (Sen. Tom Carper and Rep. Ellen Tauscher, Rep. Carolyn Maloney, and Rep. David Wu are the current co-sponsors.)

Complete streets make it possible for children to walk and bike to school safely, give seniors more security traveling to appointments, and provide everyone with safer, greener and more convenient ways of getting around without their cars.

AASHTO: Budget Change Could Cripple Multi-Year Transportation Contracting Leaders Warn

In a letter this week which commended President Barak Obama for his “expressed support for significant increased investment in transportation infrastructure,” eight major transportation and construction organizations also warned the President that a proposal contained in the Administration’s budget request to eliminate multi-year contract authority, “would undermine the very fabric of the financing mechanisms” for transportation at the very time that the nation is looking to transportation investments to help rebuild the economy.

Contract authority is a little-known budget keeping mechanism which allows states to plan and execute projects that take several years for completion. It is based upon the fact that transportation programs are funded by dedicated user fees, such as the motor fuel tax, rather than by annual appropriations. The contract authority solution for multi-year capital investment was first enacted in 1956 for highways and later extended to transit and aviation.

In a letter to President Barack Obama, the transportation leaders state, “The predictability that contract authority provides is essential for states and local governments to make long term commitments to major transportation investment projects. In 1998 with the passage of the TEA 21 legislation, Congress recognized this unique budget situation and established funding guarantees tied to the trust funds.”

Challenges Facing the Department of Transportation and Congress – The GAO’s Congressional Testimony

 The Department of Transportation received about $48 billion of recovery funds for investments in transportation infrastructure from the American Recovery and Reinvestment Act of 2009. As with other executive agencies, DOT is faced with the challenges of using these funds in ways that will aid economic recovery, making wise funding choices while spending the money quickly, and ensuring accountability for results. GAO will report to Congress bimonthly on how states and localities use the recovery funds received from DOT.

DOT and Congress will also be faced with numerous challenges as they work to reauthorize surface transportation and aviation programs.

Blue-ribbon panel endorses road pricing, shift from gas tax

A blue-ribbon federal transportation panel called today for a temporary gas-tax hike followed by a move toward charging drivers directly for every mile they travel — two ideas that have been soundly rejected by the White House in the past week.

The controversial road-pricing scheme would become the dominant funding mechanism for road construction and maintenance by 2020, with drivers being charged an average of 2 cents per mile, according to the report released by the 15-member panel created by Congress in the last highway bill authorization.

The National Surface Transportation Infrastructure Financing Commission says the shift is necessary because the current funding mechanism — federal fuel taxes — has failed to raise the necessary revenue for needed roadwork and runs counterintuitive to national environmental and energy goals.

“The more successful U.S. transportation policy is at increasing fuel efficiency and reducing both foreign oil dependency and carbon emissions, the faster its primary funding source, the gas tax, becomes obsolete,” said Texas state Rep. Mike Krusee, a commission member.

Increases in fuel economy, coupled with the fact that the current federal tax on gasoline has remained stagnant at 18.4 cents a gallon since 1993, have already taken their toll on federal revenues to fund road construction and maintenance. The Highway Trust Fund, which receives the bulk of its money from federal fuel taxes, would have run empty late last year if it were not for an eleventh-hour transfer of $8 billion by Congress to keep it solvent.

“With the expected shift to more fuel-efficient vehicles, it will be increasingly difficult to rely on the gas tax to raise the funds needed to improve, let alone maintain, our nation’s surface transportation infrastructure,” said commission Chairman Robert Atkinson, president of the Information Technology and Innovation Foundation, a nonpartisan think tank.
